Dispute Over Possession of Limerick Lands

In the Probate Division before Mr Justice Gordon, Vacation Judge, yesterday, a case regarding the goods of Mary Thair, deceased, was adjourned to determine whether Dr Hennessy of Galbally, County Limerick, would relinquish possession of the lands in the town of Knockbeg, which belonged to the estate of the deceased.

Mr Timothy Sullivan, representing Dr Hennessy and instructed by Messrs. Birch & Sons, stated that his client was not prepared to surrender possession of the premises until Mr Patrick Joseph O’Shea had obtained a grant of administration.

On the other side, Mr Michael Corayn, instructed by Mr J. J. Power and representing Mr O’Shea, countered that they could not demand possession of the lands until Mr O’Shea had obtained the necessary grant.

In response, Justice Gordon issued an order authorizing Mr O’Shea to apply for the grant of administration. Furthermore, the order directed that once Mr O’Shea had obtained the grant, he should then apply to Dr Hennessy for possession of the lands. If Dr Hennessy refused to comply, another application should be made to the court for further adjudication on the matter.

This legal proceeding highlights the intricacies involved in matters of estate administration and property ownership, underscoring the importance of legal processes in resolving disputes over possession and inheritance rights.
