“County Limerick Estate to Be Sold: Justice Ross Grants Postponement of Rental Settlement for Sale Discharge”

In a legal matter concerning the estate of Robert Ievers in County Limerick, Mr Justice Ross granted the application of Mr Boyd, representing the solicitors in charge, to postpone the settlement of the rental until after 25th March 1905. At that time, the tenancy of the owner of Castle Levers and a portion of the lands will expire, allowing for the lands to be put up for sale free from all tenancies. The estate consists of 40 acres, with 12 acres currently in the owner’s possession. The mansion house on the estate has incurred costs of £9,000, and there are additional charges amounting to £3,900, including Lord Emly’s head rent.

Mr O’Brien, K.C., acting on behalf of the owner (instructed by Mr P.K. Ryan), argued that the owner should be given the opportunity to negotiate for a loan to pay off the charges or be allowed to purchase the portion of the estate currently in his possession through the Land Commission. Mr C.F. Doyle (instructed by Mr J. Dundon) presented the views of the five sisters of the owner, who are chargeants.

Despite sympathizing with the owner’s situation, Mr Justice Ross found that the charges were not adequately secured, especially considering the heavy head rent, which would require an amount of at least £6,000 for redemption. As a result, he could not oppose the application made by the solicitors having carriage and directed the immediate preparation of advertisements for the estate’s sale during the first week of March.
