
Today, at the Limerick Assizes, a case was heard before Lord Chief Justice, Lord O’Brien of Kilfenora, involving an appeal brought by Patrick M. Harnett, W. Harnett, and Margaret Harnett (plaintiffs) against a decision made by the County Court Judge. The Judge had dismissed their claim in the Court below against Cornelius J. Leaby (defendant or respondent) for damages allegedly caused by obstruction and knocking down of a boundary fence on the plaintiffs’ land at Tournefulla in 1902, and for trespass in 1904. The amount claimed in damages was £50.
Mr P. Lynch, accompanied by Mr Holwes, BL (representing Mr R. Cussen, solicitor from Newcastle West), appeared for the appellants, while Mr P. Kelly, BL (instructed by Mr Liston, solicitor), appeared for the respondent.
After some evidence was presented, Mr Lynch, on behalf of the appellants, suggested that the case be referred back for settlement by the County Court Judge and Mr Leahy, the engineer. The suggestion was agreed upon, and the case was referred back for further consideration.
The outcome of the appeal is pending the review and settlement of the case by the County Court Judge and the engineer.
