In a significant legal ruling, Mr Justice Johnson and Mr Justice Gibson presided over a case in Dublin on Monday and concluded that the responsibility for prosecuting in a case involving the sale of intoxicating drinks without a proper license rested with the police, rather than the Revenue Authorities. The case pertained to Cornelius Cunningham of Galbally.
During the proceedings, the magistrates had adjourned the case due to a raised legal point raised on behalf of the defendant. However, they declined to formulate a legal question to refer to a higher authority for consideration. The decision by the two justices clarifies the jurisdiction of prosecution in such cases, settling the matter of which authority is responsible for pursuing legal action against individuals who engage in the sale of alcoholic beverages without the necessary license.
