Limerick Husband and Wife Dispute Moves to County Court

Before a distinguished panel consisting of the Lord Chief Justice, Mr Justice Gilmour, and Mr Justice Wright in the King’s Bench Division, a significant case involving Mr I. Curtin was heard. Representing the defendant, Mrs. Honora Curtin of Newcastle West, County Limerick, Mr Patrick Kelly (acting under the guidance of Mr James Javen) applied for a decisive order. The order in question aimed to transfer the ongoing legal action for trial to the County Court of Limerick.

The essence of the action revolved around Mr Curtin’s attempt to reclaim the sum of £123, which he asserted was owed to him for wages and funds disbursed for the defendant’s benefit. In response, the defendant mounted a counterclaim seeking £150 on comparable grounds. The parties had been embroiled in an extended legal dispute concerning the division of land. Presently, the focus was on relocating the case to the County Court, primarily to facilitate the accurate calculation of accounts.

The Court, having considered the circumstances and arguments presented, granted the application. This decision set the stage for the dispute’s progression within the County Court, marking a significant development in the ongoing litigation.
