Alleged Fraudulent Sale Unearthed in Limerick Chancery Division

In a significant legal development, the Chancery Division in Limerick witnessed proceedings in the case of Bass, Ratcliffe, and Gretton, Limited, versus Mrs. Ellie Moloney, a publican situated on High Street, Limerick. The plaintiffs, well-known brewers, sought judgment in default of defence against Mrs. Moloney in a case centred around an alleged fraudulent sale.

Represented by Mr John Linehan, instructed by Mr Robert Deyos, the plaintiffs pursued an injunction against Mrs. Moloney, aiming to prohibit her, her agents, and servants from selling or displaying for sale any ale not manufactured by the plaintiffs. Additionally, they sought an injunction restraining Mrs. Moloney from selling ale not produced by them in bottles bearing the label “Bass and Co.’s Pale Ale.”

Counsel outlined in court that the ale manufactured by the plaintiffs was distinguished by its superior quality, commanding a higher market price due to its reputable standing. The plaintiffs had adopted a distinctive label, duly registered, serving as a recognizable trademark in the market. This label, synonymous with Bass’s Pale Ale, indicated the origin and quality of the product.

The plaintiffs, although not directly involved in bottling ale, supplied their trademark labels without charge to customers who purchased their ale for bottling. This practice aimed to ensure that only their ale, distinguished by the registered label, was sold to the public. The claim contended that Mrs. Moloney had been engaging in the deceptive act of filling bottles with inferior ale, affixing the plaintiffs’ registered label, and presenting it for sale in her shop.

Mrs. Moloney, the defendant in this case, was called to appear but did not attend the proceedings. The Master of the Rolls expressed his dissatisfaction at having to address cases of fraudulent trading, emphasizing the importance of firms like the plaintiffs in exposing such malpractices.

In his ruling, the Master of the Rolls found in favour of the plaintiffs, granting the requested injunctions and awarding costs. He lamented the prevalence of fraudulent activities within the manufacturing sector, underscoring the crucial role played by vigilant companies in curbing such infringements.
