LIMERICK WAITER’S WILL: LEGAL PROCEEDINGS UNFOLD

In a legal development, an application for the time and mode of the trial in the case of Flynn v. McInerney was heard yesterday in the Probate Court before Mr Justice Madden. The plaintiff, James Flynn, proprietor of Cruise’s Hotel in Limerick, acts as the executor seeking to validate the will of the late Patrick MTnernev, who served as the head waiter at “Cruise’s” for many years.

The intricacies of the case were unveiled as it was revealed that the testator, Patrick McInerney, had, some time before his demise, summoned Mr Philip O’Sullivan, a solicitor, and Mr Quaid, an accountant with the County Council. During this meeting, the testator expressed his desire to draft a will. Consequently, the will was prepared and executed, outlining the distribution of substantial assets, including money in the bank, premises in Dublin, and an insurance policy.

However, complications arose as Catherine MTnernev, the widow of the testator, displayed dissatisfaction with certain provisions outlined in the will. In response, she lodged a caveat and filed a defence that incorporated the three statutory pleas. Notably, one of these pleas alleged undue influence. Furthermore, the defendant issued a notice, indicating her intention to cross-examine witnesses who would be presented supporting the will.

Given these circumstances, counsel for the plaintiff sought to have the trial scheduled for the 15th of December without a jury. Additionally, they requested the discovery of documents relevant to the case. On the defendant’s side, a similar application for discovery was made. Mr Justice Madden, presiding over the proceedings, acceded to the requests and fixed the trial for the specified date in December.

Mr Michael Comyn, instructed by Mr Philip O’Sullivan, appeared on behalf of the plaintiff, while Mr represented the defendant. The legal proceedings surrounding the will of Patrick MTnernev underscore the complexities that can arise in matters of inheritance and the importance of a thorough legal process in resolving such disputes.
