£170 Awarded in Limerick Partnership Dispute

In a case before the Master of the Rolls, Dargan v. Connolly, a dispute over a partnership in Limerick was brought to resolution, with a final award of £170 to the plaintiff, Mr Dargan.

The issue at hand revolved around whether a partnership existed between Mr Dargan, an a shoemaker in Limerick, and Mr Connolly, a stonecutter, concerning the John Street and Nicholas Street Improvement Scheme in the city, with a contract value of £2,200. The terms of their alleged partnership stipulated that Mr Dargan would provide the capital, while Mr Connolly would receive a weekly payment of £1. The Corporation’s cheques were intended to reimburse Mr Dargan for his outlays, and upon the completion of the contract, the profits were to be equally divided between the two parties.

According to Mr Dargan’s claims during his examination, he had invested a total of £1,800 in wages and monetary contributions, receiving only £1,200 from the Corporation and £460 from the sale of ballast and materials. He asserted that there remained an outstanding sum of £387 in the hands of the Corporation.

The defence, on the other hand, denied the existence of any partnership and argued that even if there was one, it was terminated in August 1902, when the accounts between the two parties were settled. They contended that no further money was advanced by Mr Dargan after that date.

After due consideration, the Master of the Rolls rendered a judgment in favour of Mr Dargan, awarding him £170 with costs. The decision acknowledged Mr Dargan’s financial contributions to the partnership and recognized the outstanding balance that was still owed to him from the Corporation.

Representing the plaintiff, Mr Dargan, were Messrs M.J. Bourke and P. Law Smith, who was instructed by Mr Ralph Nash of Limerick. On the defence side, Mr C.L. Matheson and Mr P. Lynch, who was instructed by Mr P. Connolly, presented the case for Mr Connolly.

The court’s decision puts an end to the dispute, providing a resolution to the Limerick partnership case and clarifying the financial obligations between the parties involved.
