LIMERICK LIBEL CASE APPEAL DECISION REVERSED

In a notable legal case involving the parties Joe Sheedy of Askeaton and John B Hewson of Castle Hewson, an appeal was brought before the Court of Appeal yesterday regarding a libel matter. The case had originally been heard before Mr Justice Boyd, who had rejected a motion by the plaintiff for further particulars, along with awarding costs against them.

Representing the appellant was Mr Moriarty, K.C., accompanied by Mr Cullinaghan, B.L. (acting on instructions from Mr James B Moran, solicitor in Limerick). The basis of their appeal centered on the affidavit provided by Mr Moran, where it was claimed that the plaintiff’s ability to proceed with the trial was compromised without the requested particulars.

On the opposing side, Mr Redwood Barry, K.C., along with Mr C F Doyle (engaged by Messrs Liskath and Sons, solicitors in Limerick), presented their arguments against the appeal.

The Court of Appeal rendered a unanimous decision in favor of the appellant, thereby overturning Mr Justice Boyd’s ruling. The full costs of the case were awarded to the appellant, covering both the proceedings and the appeal.
