Railway Station Mishap: Case Remitted to County Court

Yesterday, in the King’s Bench Division before Mr Justice Kenny, the case of Ryan v. Southern and Western Railway was heard. Mr Phelps, instructed by Mr Croker Barrington, appeared on behalf of the defendant company and sought an order remitting the action for trial to the County Court Judge of Limerick, sitting in Bruff.

The action was initiated by Mary Ryan, a housemaid residing in Oola, County Limerick, who sought damages for alleged personal injuries sustained due to the defendant company’s negligence in allowing the Castleconnell railway station to be in a defective condition.

It was presented in court that the plaintiff, a passenger on the defendant company’s line on December 19th of the previous year, accidentally fell on the pathway while leaving the station, resulting in a sprained ankle.

In an affidavit, Mr Robert Crawford, the secretary to the defendant company, asserted that, based on information and belief, the plaintiff had given up her ticket and proceeded to the exit gate at the end of the covered way. The plaintiff proceeded to the exit gate at the end of the covered way, where stone steps led to the public pathway. The accident, he stated, occurred because the plaintiff did not notice these steps and fell on the pathway.

The defendant company claimed to have a good defence to the action, and the plaintiff had no visible means for the payment of costs. With no opposition from the plaintiff’s side, Mr Justice Kenny made the order requested. The case was remitted to the County Court at Bruff, with the direction that the costs should be costs in the cause. This decision marks a step towards the resolution of the dispute over the alleged mishap at Castleconnell railway station.
