
In a recent development at the King’s Bench Division, a legal action brought by a passenger, Mr McDonagh, against the Great Southern and Western Railway Co, faced a setback. Mr Justice Madden rejected an application made on behalf of the defendants, seeking a change of trial venue from the county to the city of Limerick.
According to Mr McDonagh’s claims, he was onboard one of the railway company’s carriages, traveling from Limerick towards Castleconnell. During his journey, while attempting to alight at an intervening station, the train suddenly moved forward after coming to a stop, resulting in a serious leg injury for Mr McDonagh.
Seeking redress for his injuries, Mr McDonagh is pursuing damages in his case against the railway company. However, the defendants have denied any allegations of negligence in connection to the incident.
Despite the defendants’ request for a venue change, Mr Justice Madden ruled against it, meaning the trial will proceed in its current location. The legal proceedings will now continue as both parties present their evidence and arguments to determine liability and potential compensation for Mr McDonagh’s injuries.
