During the County Council meeting, the County Surveyor’s list of proposals for new works was under consideration. Mr O’Shaughnessy raised an objection to a particular recommendation for making a drain pipe through John Casey’s field to divert water flowing from the roadside into his property in Fanstown. He expressed concern that granting all such applications could incur significant costs for the county.
Mr Gubbins countered by stating that Mr Casey might take legal action against the County Council if the work was not carried out. However, the Chairman emphasized the potential financial burden if they were to grant all similar applications in the future.
After a poll, it was decided to reject the proposal in question.
Another proposal regarding draining the hollow of the old Ennis road at Redgate was brought up for discussion. Mr John Ryan advocated for its approval, citing the need to prevent accidents. On the other hand, Mr Gubbins opposed it, stating that it was similar to a recently rejected proposal from the Kilmallock district.
Mr Horan mentioned an accident that had occurred at the same location and the ongoing legal action against the Council. He acknowledged that the case could be dismissed as the person involved might not have been holding the horse’s reins at the time.
Mr Gubbins argued that approving the work now would weaken their case in the legal action. It was suggested to adjourn the matter for further consideration, and eventually, the proposal was referred back to the District Council for review.
